Terms and Conditions

By purchasing or using any BiaMetrix products or services, you agree to be bound by these Terms and Conditions.

  1. General Information

BiaMetrix provides non‑diagnostic gut microbiome testing and nutrition‑focused services designed to offer insights into gut health and to support everyday food choices.

BiaMetrix is supported by the herNutrea microbiome programme but operates as a distinct service with its own offerings and policies. These Terms govern your use of the BiaMetrix website, test kits, consultations and any related services.

  1. Privacy and Data Protection

Data Collection
We collect and process personal data such as your name, contact details, health‑related information, questionnaire responses and dietary preferences solely for the purpose of providing BiaMetrix services.

Legal Basis
We process your personal data based on:

  • contract fulfilment under Article 6(1)(b) GDPR (to provide the services you purchase), and
  • your explicit consent for health data under Article 9(2)(a) GDPR.

Data Usage
Your data is used to:

  • register and activate your test kit
  • analyse your microbiome sample
  • prepare your report and any personalised nutrition guidance or consultations
  • manage your account and communicate with you about your order and results

With your explicit consent, anonymised and/or aggregated data may also be used for research or service‑improvement purposes in a way that does not identify you.

Data Sharing
Your data is shared only with our certified laboratory partner for sample analysis. Any data shared with the laboratory is pseudonymised and linked to a unique activation code. We do not sell your personal data to third parties.

Data Retention

  • Personal data required for billing and accounting is stored for 7 years (or the period required under applicable tax law).
  • Microbiome test results are retained for up to 10 years to comply with medical‑data and quality‑assurance requirements.
  • The laboratory retains biological samples for up to one year, after which they are destroyed and cannot be further processed.

Automated Decision‑Making
We may use automated processing to help generate personalised nutrition suggestions and structure parts of your report. You have the right to request human review of any recommendation, to express your point of view and to contest automated suggestions.

Your Rights
You have the right to access your personal data, request correction or deletion, restrict or object to processing, request data portability and withdraw your consent for processing of health data at any time (without affecting the lawfulness of processing before withdrawal).

  1. Nature of the Service – No Medical or Diagnostic Use

BiaMetrix is not a diagnostic tool and does not provide medical advice.

  • BiaMetrix tests, reports, consultations, and any related content are for informational purposes only.
  • They do not diagnose, treat, cure or prevent any disease, condition or allergy.
  • Nothing provided by BiaMetrix should be interpreted as a medical opinion, diagnosis or treatment plan.

You must always consult your doctor or other qualified health professional about any medical questions, symptoms, medications, allergies or treatment decisions. Using BiaMetrix does not create a doctor–patient or other regulated healthcare‑professional relationship.

  1. Product and Service Usage

4.1 Microbiome Test
The at‑home microbiome test is intended solely for personal information about your gut microbiome. It has not been validated as a medical diagnostic test and must not be used as the basis for medical decisions. You must follow all collection and packaging instructions provided with your kit.

4.2 Consultations and Nutrition Guidance
Consultations and written guidance are based on the information you provide (for example, health history, symptoms, preferences and lifestyle).

Recommendations are intended to support general gut‑friendly eating and wellbeing. Any material changes to diet, lifestyle or supplements, particularly if you have existing medical conditions or take prescription medications, should be discussed with your healthcare provider.

  1. Allergies, Intolerances and Personal Responsibility

BiaMetrix is not responsible for any allergic reactions, intolerances or adverse responses that may occur from foods, supplements or lifestyle changes you choose to implement.

  • You remain solely responsible for identifying and avoiding foods or substances that may trigger allergies, intolerances or other reactions.
  • If you have known allergies or intolerances, you must carefully review all suggestions, recipes and examples, and make appropriate substitutions or avoidances based on your own needs and the advice of your healthcare provider.
  • In the event of any suspected allergic reaction or serious symptom, you must seek immediate medical attention.
  1. Activation, Results and Sample Handling
  • Each test kit includes a unique activation code. You must activate your kit online before sending your sample. Unactivated kits cannot be processed.
  • Results are delivered digitally (e.g., via an online portal or a secure link). You will be notified by email once your results are ready.
  • Standard processing time is typically 2–4 weeks from receipt of your sample at the laboratory. This is an estimate only and may be affected by shipping times, lab workload or other factors.
  • Kits include stabilising solution and packaging designed to preserve sample quality during normal transit conditions. You are responsible for following all instructions on collection, storage and shipping.
  • If, despite following instructions, your sample is insufficient or cannot be analysed (for example, due to leakage or technical failure), BiaMetrix will provide a new test kit at no additional cost.
  1. Shipping, Returns and Right of Withdrawal

Shipping
Test kits are dispatched within the typical timeframe indicated on the website. Actual delivery times may vary by destination and postal service.

Returns and Withdrawal

  • You have the right to withdraw from the purchase of a test kit within 14 days of receiving it, provided the kit is unused and unopened in its original packaging.
  • Opened kits cannot be returned for hygiene and laboratory‑safety reasons.
  • To exercise your right of withdrawal, you must clearly notify BiaMetrix (for example by email or contact form) within the 14‑day period.
  • You are responsible for arranging and paying for return shipping of unopened kits. A tracked service is strongly recommended.

Refunds
After receiving and inspecting a returned unopened kit, BiaMetrix will process the refund using the same payment method you used for the original transaction, unless otherwise agreed.

  1. Limitations of Liability

To the fullest extent permitted by law:

  • BiaMetrix is not liable for any decisions, actions or outcomes arising from your use or interpretation of test results, reports, consultations or website content.
  • BiaMetrix is not liable for delays or failures in delivering results caused by events beyond its reasonable control (including postal or courier delays, customs checks, laboratory issues or technical failures).
  • BiaMetrix is not liable for allergic reactions, intolerances, side‑effects, injuries or health issues related to foods, supplements or lifestyle changes that you choose to adopt.

In any event, the total aggregate liability of BiaMetrix in connection with any product or service shall not exceed the amount you paid for that product or service. Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by law.

  1. Intellectual Property

All BiaMetrix content, including logos, branding, text, graphics, reports, website content and educational materials, is protected by intellectual property laws. You may use your personal report and materials for your own private use only. You may not copy, reproduce, adapt, distribute or publish BiaMetrix materials for commercial purposes without prior written permission.

  1. Governing Law and Jurisdiction

The laws of Ireland govern these Terms and Conditions (unless updated to another jurisdiction once confirmed). Any disputes arising from or relating to these Terms shall be subject to the non‑exclusive jurisdiction of the courts of that jurisdiction, without prejudice to any mandatory consumer‑protection rights you may have in your country of residence.

  1. Amendments

BiaMetrix may update or amend these Terms and Conditions from time to time. Significant changes will be posted on the website and the “Last updated” date will be revised. Continued use of BiaMetrix products or services after such changes constitutes acceptance of the updated Terms.

  1. Customer Responsibilities

By using BiaMetrix you agree that:

  • You will provide accurate and complete information when registering, completing questionnaires and activating kits.
  • You will follow all instructions supplied with the test kit and in your digital materials.
  • You will not use BiaMetrix products or services for any unlawful purpose or in a way that could damage BiaMetrix’s reputation or rights.
  1. Force Majeure

BiaMetrix is not liable for delays or failures to perform obligations where such delay or failure results from events beyond its reasonable control, including but not limited to natural disasters, pandemics, governmental actions, war, strikes or failures of transport or telecommunications.

  1. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the maximum extent permitted by law.
